§ General provisions

  1. This Terms and Conditions document constitutes the regulations for the provision of electronic services within the meaning of art. 8 of the Act of 18 July 2002 on the provision of electronic services (Journal of Laws 2016.1030, i.e., of 2016.07.15.).

  2. Upon commencement of using the Etha Moss Online Store, a Client agrees to comply with the provisions of these regulations.

§ Definitions

The terms used in the Regulations shall have the following meanings:

  • Etha Moss Online Store - an online store dealing with the sale of products at a distance using electronic means of communication available at www.ethamoss.com run by Dorota Zdrojewska as part of her unregistered activity.

  • Services - services provided by the Etha Moss Online Store electronically via www.ethamoss.com on the basis of these Regulations.

  • Customer - a person or entity making a purchase from the Etha Moss Online Store

  • Products - hand-made ceramics offered by the Etha Moss Online Store via the www.ethamoss.com website

  • Regulations - these Regulations.

§3 Types and scope of services

Services provided The Etha Moss Online Store provides the following Services to Customers:

a) distance sale of products using electronic means of communication,

b) providing a Newsletter

§4 Terms of provision of electronic services

  1. To use the Services provided by the Etha Moss Online Store, you need a device with access to the Internet equipped with software needed for ordinary web browsing.

  2. In order to use the Services provided by the Etha Moss Online Store, it is not necessary to register in the Etha Moss Online Store.

  3. Only an adult with full legal capacity is authorized to use the Services provided by the Etha Moss Online Store. In the case of entities that are not natural persons, purchases in the Etha Moss Online Store may be made by a person authorized to act on behalf of a given entity or authorized by such a person.

  4. The contract for the provision of services is concluded when a Customer starts using the Services offered by the Etha Moss Online Store, indicated in these Regulations.

  5. The agreement referred to in the previous sentence is indefinite, however, a Customer may at the moment cease to use the Services offered by the Etha Moss Online Store, which will be tantamount to termination of the concluded contract.

§5 Rules for using the Etha Moss Online Store

  1. The ceramics offered by the Etha Moss Online Store are hand-made and bear the hallmarks of handicraft. Due to the manual technique of production, the products are similar, but not identical.

  2. To successfully place an order, it is not necessary to register an Account in the Etha Moss Online Store.

  3. The prices of products, expressed in PLN (PLN), in the Etha Moss Online Store are gross prices and do not include shipping costs. Shipping prices are listed separately.

  4. Before confirming the order of a given product, the Etha Moss Online Store will provide a Customer with the following information: a) a photo of the product, where the photos of the products are for illustrative purposes. The colors of the Products may slightly differ from the actual ones – they depend, for example, on the monitor settings (color saturation and other settings); (b) an exact description of the product concerned and its characteristics; c) the total value of the ordered products, d) the cost of delivery of the ordered product or products and a summary of the total value of the order with the selected delivery option, e) information on the method and date of payment, f) information on the method and date of order completion by the Etha Moss Online Store.

  5. Before placing an order, a Customer should carefully read the product description available in the Etha Moss Online Store.

  6. After selecting the product, a Customer should indicate the number of ordered copies of the product, then select the "go to shop" option.

  7. In order to finalize the order, a Customer should select the "cart" option or go directly to the cart through the cart icon on the Home Page.

  8. Then a Customer will be redirected to the "cart" subpage, where a Customer will be asked to accept the data needed for the order. In addition, at this stage, a Customer has the option of entering a discount code - if it is provided for by the Etha Moss Online Store and previously communicated to a Customer (e.g. through the social media channels of the Etha Moss Store; received in printed form in a package delivered to a Customer, as part of a previously completed order).

  9. After accepting the data necessary to place an order, a Customer will be redirected to a subpage where he will be able to complete the order. Then a Customer should choose the payment method available in the Etha Moss Online Store (enter the necessary data needed to make the payment) and the delivery method (courier service; parcel locker), and then click on the "Order and Pay" button.

  10. After selecting the "Order and Pay" button, a Customer will be redirected to the website of his/her bank or after completing the necessary data needed to make the payment, the payment for the order will be made.

  11. After completing the payment, a Customer will be redirected back to the Etha Moss Online Store to the subpage with the summary of the order.

  12. A Customer should submit a payment order immediately after placing the order. Failure of the payment process might result  in failure to place an order. In such a situation, a Customer may re-order at any time. In a situation where a Customer has any problems with the payment process, he/she should contact the Etha Moss Store via e-mail (email: info@ethamoss.com).

  13. Confirmation of acceptance of the order is sent automatically to the e-mail provided by a Customer when placing the order. In the event of doubts as to the correctness of a Customer's data provided in the form, the Store may suspend the acceptance and execution of the order. In such a situation, the Etha Moss Online Store will immediately contact a Customer to clarify doubts.

  14. A Customer and the Etha Moss Online Store are bound by the price of the product valid at the time of placing the order.

  15. The ordered product is sent within 7 business days of booking the payment, unless for reasons beyond the control of the Etha Moss Online Store it is not possible to ship the order within this period. In such a situation, the Etha Moss Online Store will inform a Customer about the extended delivery time, indicating at the same time the expected time of order completion.

  16. Shipments are sent via DPD and Inpost courier companies, also to InPost Parcel Lockers. Shipping costs are not included in the price of the product.

  17. The cost of shipping in the Polish is visible when placing an order. The cost of foreign shipments is determined individually with a Customer – depending on the destination of delivery.

  18. If a Customer orders several products, they will be packed in one shipment, unless a Customer indicates a different method of packaging and delivery of the order when placing the order. In the case of shipment of products in a manner other than the standard specified in the Etha Moss Online Store, any risk of accidental loss or damage to the product passes to a Customer at the moment of its delivery to a Customer.

  19. The ordered goods are each time accompanied by a confirmation of purchase in electronic form (sent to a Customer's e-mail) or invoice (issued only on request and sent to a Customer's e-mail). If it is necessary to issue an invoice, a Customer is obliged to provide the following data: a) Name and surname / company, b) Address of residence / registered office, c) NIP number (in the case of companies), PESEL number (natural persons), d) description of the order e) Correspondence address.

  20. Upon placing an order in the Etha Moss Online Store, a Customer agrees to send information related to status of the order to the e-mail address provided by him/her.

  21. All products marked in the Store as available products may be ordered by a Customer, unless the Etha Moss Online Store has posted a message that the product is unavailable soon. It is also possible that the availability of the product has changed from the moment of placing the order to the time of its implementation, in which case the Etha Moss Online Store is obliged to immediately inform a Customer about the lack of availability of a given product and immediately refund the payment to a Customer's bank account from which the payment was made, unless a Customer agrees to partial execution of the order (e.g. in the case of, when there are several products in one order) or its exchange for another product.

  22. When receiving a courier shipment containing the ordered product, a Customer should carefully check the status of the shipment - in particular, he should check whether the shipment is not damaged. If the shipment bears traces of damage (e.g., significant crushing of the package or by breaking the security tapes), a Customer should refuse to collect the parcel, and then inform the Etha Moss Online Store about the above event.

§6 Customers right

  1. A Customer has the right to return the goods purchased within 14 calendar days counted from the moment of delivery. A Customer may withdraw from the contract by sending the Etha Moss Online Store a Statement of Withdrawal from the contract The statement should be sent in the form of a scan in an e-mail to the following address: info@ethamoss.com. The statement must contain information allowing identification of the order, i.e.: order number or data of the ordering person (name, surname, e-mail) and the date of joining the contract / purchase.

  2. In the event of withdrawal from the contract, it is considered void. In such a situation, the Etha Moss Online Store will refund the costs to a Customer, equal to the costs incurred by a Customer during the purchase, i.e., the price of the product and shipping costs to a Customer and within 14 days of delivery.

  3. The Etha Moss Online Store will refund the payment to a Customer using the same method of payment as chosen by a Customer during the execution of the order or to the bank account provided by a Customer in the form. A Customer is responsible for reducing the value of the Product resulting from using it in a way other than it was necessary to establish the nature, characteristics and functioning of the Product.

§7 Newsletter

  1. The Etha Moss Online Store offers its Customers the Newsletter Service, which consists in sending by the Etha Moss Online Store to the email address indicated by a Customer information about current products and services of the Etha Moss Store.

  2. A Customer who wants to use the Newsletter service should fill in a dedicated form available on the Etha Moss Store website. A Customer may at any time resign from further subscription to Newletter by sending information about the resignation from the Newsletter to the info@ethamoss.com address.

§8 Complaint procedure

  1. Complaints regarding the use of Services provided by the Etha Moss Online Store should be sent in electronic form to the e-mail address of the Etha Moss Store: info@ethamoss.com.

  2. The complaint should indicate the name and surname of the person submitting the complaint, the e-mail address to which the response to the complaint is to be sent and the reason for submitting the complaint should be accurately described.

  3. The Etha Moss Online Store considers the complaint within 14 days from the date of receipt of a Customer's complaint. This period may be extended if consideration of the complaint within the time limit indicated in the previous sentence is impossible for reasons beyond the control of the Etha Moss Store. In this case, the Etha Moss Online Store is obliged to notify a Customer about the reason for the inability to consider the complaint within the time and expected time of its consideration before the deadline for considering the complaint.

  4. Information on the method of considering the complaint or the inability to consider the complaint within the deadline Etha Moss Online Store sends to a Customer's e-mail address indicated by him in the complaint or by post to the correspondence address indicated by a Customer in the complaint.

§9 Privacy Policy. Cookies

  1. The protection of private information concerning Customers is a priority for the Etha Moss Online Store, therefore the Etha Moss Online Store makes every effort to ensure that Customers can feel free and safe using the Etha Moss Store.

  2. The Privacy Policy applies to all information of a private nature, including personal data of Customers, which is collected and processed through the Etha Moss Store.

  3. The website of the Etha Moss Online Store uses Cookies. Cookies are IT data, in particular text files, which are stored on the user's end device and are intended for using the Website. Cookies usually contain the name of the website from which they originate, the time of their storage on the end device and a unique number. The entity placing cookies on the user's end device and obtaining access to them is the Etha Moss Online Store.

  4. Cookies are used to create statistics that help to understand how users use the Etha Moss Store website. Thanks to this, the Etha Moss Online Store will be able to improve its website. As part of the website of the Etha Mosss Online Store, two basic types of cookies are used: "session" cookies and "persistent" cookies. "Session" cookies are temporary files that are stored on the User's end device until leaving the website or turning off the software (web browser). "Persistent" cookies are stored on the user's end device for the time specified in the cookie parameters or until they are deleted by the User.

  5. A Customer agrees to the storage of Cookies on his/her computer for the purposes set out in the previous paragraphs.

  6. A Customer may block the storage of cookies on his/her device at any time. To do this, the settings of the browser used by a Customer must be properly configured. The function of disabling the storage of cookies on your device can generally be found in the "settings", "options" or "preferences" of the Internet browser used.

  7. In case of doubt or for detailed information, please use the "help" option of the Internet browser used.

§10 Personal data

  1. In order to properly implement the services available as part of the Etha Moss Store, the Etha Moss Online Store processes personal data of Customers, including name, surname, address, date of birth, bank account number, e-mail address and telephone number.

  2. The administrator of personal data of Etha Moss Online Store Customers is Dorota Zdrojewska.

  3. When using the website, the Etha Moss Online Store also collects information about a Customer's device in order to ensure the correct operation of services: computer IP address, information contained in cookies or other similar technologies, session data, web browser data, device data, data on website activity, including on individual subpages, geolocation information, if the user has consented to access to geolocation Geolocation information is used to provide more tailored product and service offerings.

  4. The Etha Moss Online Store processes personal data of Customers in order to enable Customers to use all the functionalities available in the Etha Moss Online Store.

  5. Providing personal data by a Customer is voluntary, however, failure to provide personal data or lack of consent to their processing will prevent the use of some Etha Moss uses the services of third parties, e.g., in the field of payment processing (Stripe) in the scope of delivery of ordered goods - courier companies (DPD, Inpost). The transfer of Customers' personal data to third parties cooperating with the Etha Moss Store is only for the purpose of proper execution of the order and takes place in accordance with the provisions of law on the protection of personal data. The Etha Moss Online Store does not provide third parties with personal data of Customers for a fee.

  6. A Customer has the option of subscribing to the newsletter by filling out the form available on the Etha Moss Store website, providing his/her e-mail address. This is completely voluntary.

  7. A Customer may unsubscribe from further newsletter subscriptions at any time. In connection with the processing of personal data by the Etha Moss Online Store, each Customer has the right to: a) access their personal data, b) request rectification of their personal data, c) request the restriction of the processing of their personal data, d) request the deletion of their personal data, in the event that the Etha Moss Online Store will not be obliged by law to process them, e) transfer your personal data, i.e. the possibility of obtaining your personal data in a structured, commonly used machine-readable format and the right to send this data to another administrator. If it is technically possible, a Customer has the right to request the transfer of his/her personal data to another administrator directly by the Etha Moss Online Store.

  8. A Customer has the right to lodge a complaint with the President of the Office for Personal Data Protection as a supervisory body in the field of personal data protection, if he believes that his/her personal data is processed by the Etha Moss Online Store in a manner inconsistent with the provisions of law on the protection of personal data.

  9. In order to obtain information regarding their personal data, a Customer may contact the Etha Moss Online Store in the form of an email sent to the address info@ethamoss.com or in writing to the following address: M.C. Skłodowskiej 8a/11; Gdynia 81-231, Poland.

  10. In a situation where a Customer wants to withdraw consent to the processing of data, he should also inform the Etha Moss Online Store via e-mail or in writing to the addresses indicated in the previous sentence.

§11 Final provisions

  1. The Regulations are effective from the moment they are published in the Etha Moss Online Store.

  2. Etha Moss Online Store is entitled to change these Regulations at any time. Any amendments to the Regulations will be communicated to Customers in the Etha Moss Online Store and will be effective from the moment of notifying Customers about the changes by publishing the Regulations in new content on the Etha Moss Store website.

  3. To the extent not covered by these Regulations, the provisions of generally applicable Polish law shall apply.
